Job Description

Job Title: Pre-Development & Construction Attorney

Position Overview:

We are seeking an experienced Pre-Development & Construction Attorney to provide legal guidance on all aspects of real estate development and construction. This role involves advising on land acquisition, entitlements, construction contracts, risk management, and regulatory compliance. The ideal candidate will have expertise in real estate development law, construction law, zoning regulations, and dispute resolution.

Key Responsibilities:

Pre-Development & Land Use

  • Advise on legal aspects of site selection, land acquisition, and due diligence.
  • Review and negotiate purchase agreements, easements, and land use restrictions.
  • Guide clients through zoning, permitting, and entitlements processes.
  • Represent developers before planning boards, zoning commissions, and municipal agencies.

Construction Contracts & Risk Management

  • Draft, review, and negotiate construction contracts, including AIA agreements, EPC contracts, and subcontractor agreements.
  • Provide legal guidance on procurement strategies, bidding processes, and contractor negotiations.
  • Advise on insurance, bonding, and indemnification provisions to mitigate project risks.
  • Ensure compliance with local, state, and federal regulations governing construction projects.

Regulatory Compliance & Permitting

  • Assist in obtaining necessary building permits, environmental approvals, and regulatory clearances.
  • Monitor legal changes affecting construction and development projects.
  • Ensure compliance with OSHA, ADA, and other applicable laws.

Dispute Resolution & Litigation Support

  • Manage disputes related to construction defects, contract breaches, and project delays.
  • Represent clients in mediation, arbitration, and litigation when necessary.
  • Collaborate with outside counsel on complex legal matters.

General Real Estate & Development Advisory

  • Advise developers, investors, and construction firms on structuring development agreements.
  • Negotiate joint venture and public-private partnership agreements.
  • Assist with financing arrangements, including lender negotiations and security agreements.

Qualifications & Experience:

  • Juris Doctor (JD) degree from an accredited law school.
  • Active bar membership in good standing (state-specific requirement).
  • 5+ years of experience in real estate development, construction law, or related practice areas.
  • In-depth knowledge of construction contracts, land use law, and regulatory compliance .
  • Experience representing developers, contractors, or investors in large-scale projects.
  • Strong negotiation, analytical, and problem-solving skills.
  • Excellent written and verbal communication skills.
